Terms of Service

Important: Please read these terms carefully before using EmergiFund's services. By applying for or using our services, you agree to be bound by these terms.

1. About EmergiFund

EmergiFund (Pty) Ltd (registration number [Registration Number]) ("EmergiFund", "we", "us", or "our") operates a subscription-based access service that provides subscribers with access to fuel and electricity resources on a structured repayment basis.

EmergiFund does not provide loans or credit. Our service is a subscription-based access arrangement and is not governed by the National Credit Act 34 of 2005 ("NCA"). If you believe you require credit, we recommend consulting a registered credit provider.

2. Eligibility

To use our services you must:

  • Be a South African citizen or permanent resident
  • Be 18 years of age or older
  • Hold a valid South African ID document or passport
  • Hold an active South African bank account
  • Have a WhatsApp-enabled mobile phone number
  • Provide proof of regular income

We reserve the right to decline any application at our sole discretion without being required to provide reasons.

3. Subscription Plans

EmergiFund offers monthly subscription plans for fuel access, electricity access, and combined fuel + electricity access. The specific plans, fees, and access amounts available are published on our Plans page and may be updated from time to time.

Monthly subscription fees are payable in advance via debit order. Your subscription must be active and your subscription fee paid before access will be granted.

4. Access Amounts

Access amounts shown on our website and marketing materials are "up to" values and are not guaranteed. Actual access amounts are determined at our discretion and are subject to approval.

First-time subscribers may receive a lower initial access amount. Your access limit may increase over time based on your repayment behaviour and history with EmergiFund.

Limited first-time access may be provided at the Company's sole discretion.

5. Repayment Obligations

When you access fuel or electricity through EmergiFund, you agree to repay the full value of the resources accessed through structured instalments as communicated to you at the time of access.

  • No interest is charged on access amounts
  • Repayments are collected via debit order from your nominated bank account
  • Repayment schedules are aligned with your stated payday where possible
  • Instalments may be structured weekly, fortnightly, or monthly

You are responsible for ensuring sufficient funds are available in your bank account on each scheduled debit date.

6. Debit Order Authority

By applying for our services, you authorise EmergiFund or its appointed collection agent to debit your nominated bank account for:

  • Your monthly subscription fee
  • Any repayment instalments due in terms of your access agreement
  • Any applicable penalty fees resulting from failed debit orders

This authority remains in force until cancelled by you in writing, provided all outstanding amounts have been settled.

7. Failed Payments

If a debit order is returned unpaid for any reason, EmergiFund may:

  • Charge a penalty fee for the failed debit
  • Suspend your access to fuel or electricity until arrears are settled
  • Cancel your subscription
  • Take steps to recover outstanding amounts

It is your responsibility to notify us in advance if you anticipate difficulty meeting a payment.

8. Cancellation

You may cancel your subscription at any time by contacting us via WhatsApp or telephone. Cancellation does not extinguish any outstanding repayment obligations. All amounts owed at the time of cancellation remain due and payable.

EmergiFund may cancel your subscription with immediate effect if you breach these terms, make fraudulent representations, or fail to meet your repayment obligations.

9. Limitation of Liability

To the fullest extent permitted by law, EmergiFund shall not be liable for any indirect, incidental, or consequential loss arising from your use of our services, including but not limited to loss of income, data, or business opportunity.

Our total liability to you in any circumstance shall not exceed the total subscription fees paid by you in the three months preceding the event giving rise to the claim.

10. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated to you via WhatsApp or email at least 30 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms or our services shall be subject to the jurisdiction of the South African courts.
